No allowance, refund or set aside will be made on account of any incorrectness, error in cataloging, imperfection, defect or damage. Any descriptions or representations are for identification purposes only and are not to be construed as a warranty of any type. It is the responsibility of the Buyer to have inspected thoroughly the items and to have satisfied himself or herself as to its condition and value and to bid based upon that judgment solely. All participants hereby agree and accept that neither Lone Star Auctioneers, Inc. nor LoneStarOnline.com will be held responsible for a failure to execute a bid on behalf of any participant(s) for any reason whatsoever. By submitting winning bid(s) on this auction, I acknowledge and accept without recourse that I have purchased the above items at public auction "as, where is" without warranty or guarantee of any kind. I will not stop payment, dispute or otherwise contest this transaction.

Payment Terms:
Payment must be made in full at Lone Star Auctioneers' Fort Worth office absolutely no later than 5:00pm. CST, December 3, 2009 (closing November 30, 2009) by Bank issued Cashier's Check or Postal Money Order made payable to Lone Star Auctioneers, Inc. We will also accept cash payments at our Fort Worth office until 5:00 pm. Please bring exact change if paying by cash. Also be sure to bring printed copy of your invoice and your Driver's License if dropping off payment. Payments must be mailed or delivered to: Lone Star Auctioneers, Inc., 4629 Mark IV Parkway, Fort Worth, TX 76106-2295. (Please do not send cash in the mail). No Pay, No return!

Additional Fees:
Chapter 2175, Texas Government Code, Title 10, Subtitle D, requires that a fee be collected from the purchaser of surplus or salvage property to recover the costs associated with the sale. A Purchasers Fee in the amount of 6.50% will be collected at settlement.

Emission Surcharge:
As required in rule changes in T.A.C., Title 34, Part 1, Chapter 3, Subchapter O, Rule 3.320 the following surcharges must be collected per tax code. Effective with those bids open after July 1, 2003 and the auctions held after that date, surcharge of 2% on the purchase of off-road, heavy duty, diesel construction equipment.

Sales Tax:
Texas State Sales tax of 8.25% will be collected from all taxable buyers taking possession of their purchases in the state of Texas for vehicles and equipment where titles are not available.

Removal:
Monday - Friday (Weekdays Only) from 8:00am - 3:00pm BY APPOINTMENT ONLY. Please contact the person at the phone number listed in the item description to schedule a removal appointment. All items MUST be removed by December 11, 2009. NOTE: There will be No assistance will be available from Texas Department of Transportation for the removal and transportation of items won. Removal is the winning bidders responsibility. TxDOT will retain ownership of any equipment / vehicles that is purchased and not removed from TxDOT property before 3:00 pm on the last removal date. Title paperwork will be provided by the rep at TxDOT via mail after paid receipt has been received. Please bring a copy of your paid receipt and valid picture ID to the pickup location when picking up. TxDOT reps will not release any items unless these items are provided. Written authorization must be provided to LoneStar Auctioneers allowing a different person other than on the paid invoice to pick up.

No deposit is required to bid at this auction. Winning bidders will receive an emailed invoice approximately 1 hour after the last lot from that auction closes. Please pay from that invoice. If you do not receive an invoice within 24 hours, Please contact our office immediately to verify that your email address is correct in the system. Anti Sniping:
Each auction ends at a specific time. However, all auctions use an auto-extend / dynamic closing feature. Thus, bidding will still remain open on any item that has received a bid within the last 5 minutes. Once 5 minutes have passed without any new bids, the auction for this item will be closed. All auction items marked with COMPLETED in red letters are considered closed and no longer available for bidding. Please make sure to refresh your web browser often to make sure the item does not auto-extend.
