A Storage Lien Certificate will be supplied to the winning bidder for title paperwork (unless otherwise stated in the description above). Winning bidders must first pick up their vehicle paperwork at Capital Tow’s corporate office at 1000 S Canton Drive, Fort Worth, Texas 76112 and then retrieve their item (Item location will vary). All vehicles are subject to Standard Presumptive Value. Vehicles marked with NO TITLE are subject to standard 8.25% sales tax and cannot be titled through local tax offices. All paperwork MUST made out in the company name exactly as it appears on the winning bidder’s online account at the time of auction close. If a no company name is provided, then it will be listed in the individual name exactly as it appears on the winning bidder’s online account at the time of auction close. Updating your online account information AFTER the item closes will not update your title paperwork information. All title paperwork will appear exactly like it is on your invoice. No changes to paperwork will be allowed. No exceptions!

Additional Fees:
A 10% buyers premium will be collected at settlement from ALL winning bidders.

Acceptance of Terms:
All persons participating in the on-line bidding agree to and accept these terms and conditions unequivocally and without exception. All items are sold AS IS, WHERE IS with NO warranties implied or expressed. No allowance, refund or set aside will be made on account of any incorrectness, error in cataloging, imperfection, defect or damage. Any descriptions or representations are for identification purposes only and are not to be construed as a warranty of any type. It is the responsibility of the Buyer to have inspected thoroughly the items and to have satisfied himself or herself as to its condition and value and to bid based upon that judgment solely. Any discrepancy with any item description must be dealt directly with the SELLER listed above and not Lone Star Auctioneers employees. All participants hereby agree and accept that neither Lone Star Auctioneers, Inc. nor LoneStarOnline.com will be held responsible for any errors in descriptions or any failure to execute a bid on behalf of any participant(s) for any reason whatsoever. By submitting winning bid(s) on this auction, I acknowledge and accept without recourse that I have purchased the above items at public auction "as, where is" without warranty or guarantee of any kind. I will not stop payment, dispute or otherwise contest this transaction. Buyer acknowledges and accepts the possibility of deficiencies in antipollution devices of all vehicles.

NEW Payment Terms as of 02/26/13:

  • Full and complete payment must be received by Lone Star Auctioneers no later than May 24, 2013 (closing May 21, 2013).
  • Priority Mail, Express ship or deliver payment to: Lone Star Auctioneers, Inc., 4629 Mark IV Parkway, Fort Worth, Texas 76106-2295. You must include a copy of your invoice with your payment.
  • All payments should be made payable in U.S. Dollars ($USD) to Lone Star Auctioneers.

Any bidder(s) who does not pay for his/her online purchases by the deadline shall not be allowed to register or participate in any future auctions conducted by Lone Star Auctioneers, Inc. (live, webcast or 24/7 online).

NOTE: All invoices totaling $10,000.00 or more MUST be paid with a wire transfer. (The $25 wire transfer fee will be waived.)

Methods of Payment Accepted:
  • CASH is accepted at our office Monday - Friday from 8:00 a.m. - 5:00 p.m. (DO NOT SEND CASH in the mail.) Please bring exact change if paying by cash, and you must bring a printed COPY OF YOUR INVOICE and YOUR DRIVER'S LICENSE.
  • CASHIER'S CHECK issued by a U.S. bank made payable to Lone Star Auctioneers.
  • CHECKS WITHOUT A BANK LETTER OF GUARANTEE made payable to Lone Star Auctioneers will have a taxable 3% processing fee added. Personal checks require your driver's license number, valid physical address (no PO Boxes) and phone number. Company checks without a bank letter of guarantee are only accepted in-person at the Lone Star Auctioneers office. When we use information from your check to make an electronic fund transfer, funds may be withdrawn from your account as soon as the same day we receive your payment, and you will not receive your check back from your financial institution.
  • CHECKS WITH A BANK LETTER OF GUARANTEE made payable to Lone Star Auctioneers and strictly worded as follows:

    "This bank will guarantee unqualified payment to Lone Star Auctioneers on Account #_________________ in the amount of $_________________. This letter will expire 30 days from the date of issuance."

When we use information from your check to make an electronic fund transfer, funds may be withdrawn from your account as soon as the same day we receive your payment, and you will not receive your check back from your financial institution.

  • U.S. POSTAL MONEY ORDER made payable to Lone Star Auctioneers.
  • VISA, MASTERCARD AND DISCOVER will have an added convenience fee of $25.00 per transaction. (This fee is taxable if you pay sales tax on your invoice).
  • WIRE TRANSFERS will have an additional fee of $25.00 (Domestic) or $50.00 (International) added. Please contact OnlineService@LoneStarAuctioneers.com for wiring instructions. Note: This IS NOT the same as a Bank Direct Deposit of Funds. We do not accept Bank Direct Deposits as a form of payment. (This fee is taxable if you pay sales tax on your invoice).

Winning bidders will receive an emailed invoice APPROXIMATELY 1 hour after the last lot from that auction closes. Please pay from that invoice. If you do not receive an invoice within 24 hours, please contact our office immediately to verify that your email address is correct in the system. Important Notice: If you are using an email service provider that has a built-in spam blocker (AOL, Yahoo, Hotmail, Gmail, Earthlink, AT&T, SBCGlobal, etc... MOST include this service now-a-days), please make sure you approve emails from both LoneStarOnline.com and LoneStarAuctioneers.com. Otherwise, invoices, out bid notifications and paid receipts may be automatically blocked or put into a deleted / junk / spam folder. It is the bidder's responsibility to contact us regarding their invoice total if it is not received within a 24 hour period. To verify if you are the winning bidder on a lot, log into the MY ACCOUNT section at the top of LoneStarOnline.com, click the link that says VIEW YOUR BIDDING HISTORY, then click the "+" (plus sign) under ITEMS IVE WON. It will expand a table that displays all the items you have won in the last 30 or 60 day period.

Additional Fees:

Sales Tax:
Texas State Sales tax of 8.25% will be collected from ALL buyers taking possession of their purchases in the State of Texas with the exception of vehicles and equipment where titles are available.

As required in rule changes in T.A.C., Title 34, Part 1, Chapter 3, Subchapter O, Rule 3.320 the following surcharges must be collected per tax code. Effective with those bids open after July 1, 2003 and the auctions held after that date, surcharge of 2% on the purchase of off-road, heavy duty, diesel construction equipment.

New Tax Exemption Requirements as of 01/01/12:
Texas House Bill 268, passed during the 82nd Regular Legislative Session (2011), requires that a person claiming an exemption from sales tax on the purchase of certain items used in the production of agricultural and timber products must provide a registration number issued by the Comptroller of Public Accounts on the exemption certificate issued to the seller. All buyers who wish to claim TAX EXEMPT (farm use or non-profit) or RESALE to have taxes legally removed from their invoice MUST (1) PROVIDE A COPY of your RESALE TAX CERTIFICATE for Lone Star's records the first time you make the claim and (2) completely FILL OUT THE RESALE TAX CERTIFICATE PORTION at the bottom of EVERY INVOICE.  No paid receipts will be issued unless the required information is received at the time of payment.  NO EXCEPTIONS!

Item Removal:
Weekdays, Monday - Friday between 8:00am to 5:00pm.
Winning bidders must first pick up their vehicle paperwork at Capital Tow’s corporate office at 1000 S Canton Drive, Fort Worth, Texas 76112 and then retrieve their item (Item location may vary). All items must be removed within 5 business days of auction close or the buyer will be charged a $21.65 storage fee per day. ALL VEHICLES must be towed from Capital Tow premises at the winning bidder’s expense by a TXDOT certified wrecker. No trailer, car dolly or tow bar may be used inside the lot. If items purchased are not removed within 30 days of auction close, the buyer forfeits all monies paid and the property reverts to the Capital Tow with no recourse. Please give the attendant your paid receipt and a valid Government issued ID when picking up all items. Individuals without a paid receipt and valid ID will not be able to remove items from lot. No changes to paperwork will be allowed. Capital Tow staff will not be responsible for the loading of auctioned vehicles. Buyers of auctioned vehicles shall make their own arrangements accordingly. Disposing of unwanted materials off of or from auctioned vehicles will not be tolerated and will result in permanent banning from all Live and Online auction conducted by Lone Star Auctioneers.

Anti Sniping / Dynamic Closing:
Each auction item is scheduled to end at a specific time. However, all LoneStarOnline auctions use an AUTO EXTEND / DYNAMIC CLOSING feature. Thus, bidding will still remain open on any item that receives a bid within the last 5 minutes prior to the scheduled closing time. Time extensions are added in 5 minute intervals to the original auction closing time and to each extension’s closing time when a bid is placed. For example: if an item is scheduled to close at 10:00am, and a bid is placed between 9:55am to 10:00am, the closing time will be extended by 5 minutes until 10:05am. If a bid is placed within that 5 minute interval, then bidding the closing time will extend until 10:10am, etc… Once a 5 minute extension interval has passed without any bids, the auction for the item will close, and the lot will show as COMPLETED in red letters. This means that bids are no longer accepted, and the username showing is the winning bidder. To make sure you see all other bids placed, click the “Refresh” button on your web browser frequently before that item closes and during any extension periods. Your screen may not “auto-refresh,” and you may not see bids placed after yours if you don’t manually refresh.

The bidder acknowledges and accepts that Lone Star Auctioneers, Inc. does not guarantee continuous, uninterrupted service or secure access to our website. Operation of our website may be interrupted, interfered with or adversely affected by numerous factors or circumstances outside of our control. Neither Lone Star Auctioneers, Inc. nor any of its sellers, agents, or any provider or third-party vendor will be liable for nor have any responsibility for any loss or damage incurred in the event of any failure or interruption of the website or internet bidding, or from any other cause regarding access to or inability to access the site or its materials, or to place bids whatever the perceived cause. In the event of service interruption during the course of internet auctions, Lone Star Auctioneers, Inc. and its sellers reserve the right to terminate the interrupted auctions and declare all bids in those auctions null and void, to allow auctions to continue to run after an interruption, to relist and restart affected auctions at the original starting bid or the high bid at the time of the interruption, to restart all auctions containing any lots of merchandise affected by an interruption or to take any other action deemed necessary. The auctioneer’s decision, with Seller’s consent, shall be final without recourse or liability.
