Titles will be assigned to the name and mailing address as it appears in your online registration account at the time of auction close. If the buyer is registered with a company name, the title will be assigned to the company name. Otherwise, the title will be assigned to the buyer's name. Titles will be mailed to the mailing address provided in your bidder account. Before close of an auction, confirm your bidder information for accuracy and make any necessary changes. ANY AND ALL CORRECTIONS TO BUYER INFORMATION MUST BE DONE PRIOR TO ITEM CLOSING. Titles will be mailed approximately one week after the close of the auction. NO CHANGES TO TITLE PAPERWORK WILL BE ALLOWED.

Acceptance of Terms:
All persons participating in the on-line bidding agree to and accept these terms and conditions unequivocally and without exception. All items are sold AS IS, WHERE IS with NO warranties implied or expressed. No allowance, refund or set aside will be made on account of any incorrectness, error in cataloging, imperfection, defect or damage. Any descriptions or representations are for identification purposes only and are not to be construed as a warranty of any type. It is the responsibility of the Buyer to have inspected thoroughly the items and to have satisfied himself or herself as to its condition and value and to bid based upon that judgment solely. Any discrepancy with any item description must be dealt directly with the SELLER listed above and not Lone Star Auctioneers employees. All participants hereby agree and accept that neither Lone Star Auctioneers, Inc. nor LoneStarOnline.com will be held responsible for any errors in descriptions or any failure to execute a bid on behalf of any participant(s) for any reason whatsoever. By submitting winning bid(s) on this auction, I acknowledge and accept without recourse that I have purchased the above items at public auction "as, where is" without warranty or guarantee of any kind. I will not stop payment, dispute or otherwise contest this transaction.

Payment Terms:
Payment must be made in full at Lone Star Auctioneers' Fort Worth office absolutely no later than 5:00 pm CST, August 15, 2012 (closing August 10, 2012) by Bank issued Cashier's Check or Postal Money Order made payable to Lone Star Auctioneers, Inc. We will also accept cash payments at our Fort Worth office Monday - Friday from 8:00am - 5:00 pm. Please bring exact change if paying by cash. Also be sure to bring printed copy of your invoice and your Driver's License if dropping off payment. Mail or deliver payment to: Lone Star Auctioneers, Inc., 4629 Mark IV Parkway, Fort Worth, TX 76106-2295. (Please do not send cash in the mail).

Winning bidders will receive an emailed invoice APPROXIMATELY 1 hour after the last lot from that auction closes. Please pay from that invoice. If you do not receive an invoice within 24 hours, please contact our office immediately to verify that your email address is correct in the system. MOST include this service now-a-days), please make sure you approve emails from both LoneStarOnline.com and LoneStarAuctioneers.com. Otherwise, invoices, out bid notifications and paid receipts may be automatically blocked or put into a deleted / junk / spam folder. It is the bidder's responsibility to contact us regarding their invoice total if it is not received within a 24 hour period. To verify if you are the winning bidder on a lot, log into the MY ACCOUNT section at the top of LoneStarOnline.com, click the link that says VIEW YOUR BIDDING HISTORY, then click the "+" (plus sign) under ITEMS IVE WON. It will expand a table that displays all the items you have won in the last 30 or 60 day period.

Additional Fees:
Chapter 2175, Texas Government Code, Title 10, Subtitle D, requires that a fee be collected from the purchaser of surplus or salvage property to recover the costs associated with the sale. A Purchasers Fee in the amount of 6.50% will be collected at settlement.

Sales Tax:
Texas State Sales tax of 8.25% will be collected from ALL buyers taking possession of their purchases in the State of Texas with the exception of vehicles and equipment where titles are available.

As required in rule changes in T.A.C., Title 34, Part 1, Chapter 3, Subchapter O, Rule 3.320 the following surcharges must be collected per tax code. Effective with those bids open after July 1, 2003 and the auctions held after that date, surcharge of 2% on the purchase of off-road, heavy duty, diesel construction equipment.

New Tax Exemption Requirements as of 01/01/12:
Texas House Bill 268, passed during the 82nd Regular Legislative Session (2011), requires that a person claiming an exemption from sales tax on the purchase of certain items used in the production of agricultural and timber products must provide a registration number issued by the Comptroller of Public Accounts on the exemption certificate issued to the seller. All buyers who wish to claim TAX EXEMPT (farm use or non-profit) or RESALE to have taxes legally removed from their invoice MUST (1) PROVIDE A COPY of your RESALE TAX CERTIFICATE for Lone Star's records the first time you make the claim and (2) completely FILL OUT THE RESALE TAX CERTIFICATE PORTION at the bottom of EVERY INVOICE.  No paid receipts will be issued unless the required information is received at the time of payment.  NO EXCEPTIONS!

Removal:
Weekdays, Monday - Friday from 8:00am - 3:00pm.
Please allow ample time so items are off the yard before 3:00pm. Reps are not authorized to stay past 3:00pm. All items must be removed by 3:00pm on August 17, 2012. No assistance will be available from Texas Facilities Commission or Department reps for the removal and transportation of items won. Removal is the winning bidders responsibility. Any exception to the last removal date must be submitted in writing to the Texas Facilities Commission Rep. If approved, the purchaser will be notified in writing of the approval and the revised removal date. Texas Facilities Commission will retain ownership of any vehicle that is purchased and not removed from Texas Facilities Commission property by the last removal date. Please bring a copy of your paid receipt and valid picture ID to the pickup location when picking up. Texas Facilities Commission reps will not release any items unless these items are provided at pickup. Written authorization must be provided to Lone Star Auctioneers and the Texas Facilities Commission allowing a different person other than on the paid invoice to pick up.

Anti Sniping / Dynamic Closing:
Each auction item is scheduled to end at a specific time. However, all LoneStarOnline auctions use an AUTO EXTEND / DYNAMIC CLOSING feature. Thus, bidding will remain open on any item that receives a bid within the last 5 minutes prior to the scheduled closing time. Time extensions are added in 5 minute intervals to the original auction closing time and to each extension’s closing time when a bid is placed. For example: if an item is scheduled to close at 10:00am, and a bid is placed between 9:55am to 10:00am, the closing time will be extended by 5 minutes until 10:05am. If a bid is placed within that 5 minute interval, then bidding the closing time will extend until 10:10am, etc… Once a 5 minute extension interval has passed without any bids, the auction for the item will close, and the lot will show as COMPLETED in red letters. This means that bids are no longer accepted, and the username showing is the winning bidder. To make sure you see all other bids placed, click the “Refresh” button on your web browser frequently before that item closes and during any extension periods. Your screen may not “auto-refresh,” and you may not see bids placed after yours if you don’t manually refresh.
