CALIFORNIA UNCLAIMED PROPERTY ONLINE TERMS AND CONDITIONS  

All persons desiring to bid must be registered to bid at LoneStarOnline.com and must have complied with all registration, certification and any other requirements of each specific auction prior to the posted deadlines for each without fail. Only upon compliance will bidders be authorized to bid on-line. Certifications and other documentation may be required and may vary by auction. No exceptions will be made.

Lone Star Auctioneers, Inc., herein after referred to as the Auctioneer, reserves the right to add to or withdraw items from the auction on behalf of the Seller. Changes to or additional terms and conditions, additions or deletions to an auction may be posted by the Auctioneer prior to or during the course of an auction. A good faith effort will be made by the Auctioneer to post notification in the on-line auction site of additions, deletions and changes to the descriptions or terms and conditions. The Auctioneer will make a good faith effort to notify bidders of any such changes by email. The Auctioneer will not be held responsible for any discrepancies or failure in providing such information.

Lone Star Auctioneers, Inc. neither conducts any appraisal nor has any association with the appraiser for any auctions or items. The Auctioneer has no control over the appraisal or value or description of any item and does not warrant, stand behind or guarantee information contained in the appraisal or description or any values associated thereto.

The Auctioneer is acting as Agent for the Seller and all representations made by Auctioneer are made on behalf of the Seller. The Auctioneer is not responsible for the acts or representations of the Seller. Any action or recourse will be directed to the Seller and not to the Auctioneer. The descriptions contained in any material pertaining to each auction have been provided exclusively by the Seller or the Seller’s appraisers.

The Auctioneer reserves the right to reject any and all bids on behalf of the Seller and to bid as agent for any Absentee Bidder. The Auctioneer is not responsible for the acts or representations of the Seller. Any action or recourse will be directed to the Seller and not to the Auctioneer.

All items are sold AS IS, WHERE IS with no warranty, expressed or implied. The Auctioneer shall not be responsible for the correct description, authenticity, genuineness, or defect in any lot and makes no warranty in connection therewith. No allowance, refund or set aside will be made on account of any incorrectness, error in description, imperfection, defect or damage. Any descriptions or representations are for identification purposes only and are not to be construed as a warranty of any type. By bidding on any item, the Buyer waives all rights to any recourse based on quality, quantity, character, description or condition or other aspect of the item.

Shipping, handling and insurance are at the expense, liability and risk of the Buyer. The Auctioneer will provide a tracking number to winning bidders upon request in the event of delay or non-delivery of a shipment. The Auctioneer will make a good faith effort to assist buyers with shipping issues. Auctioneer shall not be responsible for non-delivery or for any other matter or thing to any purchaser of any lot, in any event. Merchandise not paid for within the specified time period may be resold without notice or recourse. Please refer to each individual auction for shipping and handling costs.

Full and complete payment must be made in the required form and must be received in Auctioneers’s office no later than the posted deadline following each auction. Buyers are responsible for sending full payment by whatever means necessary to meet the specified deadline for receipt of payment. Payment must be made specifically as stated in the terms for each auction. Seller shall retain full security interest in all merchandise until full complete payment is made to Seller or Lone Star Auctioneers, Inc. Shipping, handling, and insurance charges will be calculated and included with the invoice for payment. Merchandise not paid for within the specified time period may be resold without notice.

Upon the sale of each lot, successful Buyer will be notified via email of the final sale price, applicable sales taxes, shipping, handling and insurance. All questions or disputes regarding buyer, lot identity, price or quantity must be resolved immediately upon the sale of that lot. No changes or adjustments will be made at any time. The record of the sale kept by the Auctioneer will be taken as final in the event of any dispute.

Auctioneer is not responsible for any on-line bids received and/or executed after the item is declared sold. The Auctioneer is not responsible for any delay, discontinuation or interruption in the transmission or receipt of bids or information in on-line auctions or in the operation or performance of any software or software associated with on-line auctions.

All descriptions of items in Seller’s auction provided orally or in writing prior to or at the time of the auction are believed to be correct, but the Auctioneer makes no representation or warranty, express or implied, as to the accuracy of any such description, and hereby specifically disclaims any claim of warranty. The Buyer hereby agrees to rely solely on his/her own expertise to determine the value of any item purchased rather than the description of any article contained in the website.

The Buyer agrees that any item successfully bid upon will be paid for by the Buyer within the specified period after the auction by Cashier’s Check, personal or business check or other posted method. The Buyer further agrees to send payment by a means which will ensure that the payment is received in the Auctioneer’s office no later than the time specified in the auction terms for that auction.

To the extent that the bidder is an individual acting on behalf of a corporation registered as the bidder, the individual bidder shall be jointly and severally liable with the corporation for payment of the purchase price, taxes, shipping, handling, insurance and any other applicable charges. The Buyer acknowledges and agrees that no "stop payment" order shall be issued or honored on any check. The Buyer further agrees that a stop payment order shall be considered prima-facie evidence of intent on the part of the buyer to defraud the Auctioneer and the Seller at the time of delivery of the check. The Auctioneer reserves the right to withhold shipment of purchased lots until each check has cleared the bank.

The Buyer agrees that the act of submitting a bid shall constitute acceptance of each and every term and condition contained herein and of any additional terms and conditions which may be posted for the on-line auction site and/or the Auctioneers’ website. The Buyer agrees that in any dispute between the Seller and the Buyer or between competing bidders arising in connection with any sale at the auction, the Auctioneer shall have the right but not the obligation to settle such dispute, and the Buyer shall abide by the decision of the Auctioneer whose decision shall be final with respect to such matter. The Buyer further agrees to indemnify the Auctioneer for all liabilities, damages, costs, and expenses including attorneys fees incurred in connection with any such dispute or in connection with any claim, litigation, controversy, dispute or proceeding arising from any purchase of an article by the Buyer, from any attempt to purchase an item in an auction or from any subsequent sale of such article to any third party.

Upon payment of any amount to Seller, the Auctioneer or its assigns shall be subrogated to all of the Seller's rights of recovery. The Buyer agrees that any and all disputes arising from this auction will be resolved solely through binding arbitration in Tarrant County, Texas.

The Seller reserves the right to accept or reject any/all bids. All sales are subject to confirmation by the Seller. Any Buyer who does not pay for his or her purchases will not be allowed to register or participate in any future auctions conducted by the Seller or the Auctioneer.

Full and complete payment is due immediately upon notification of successful bid by Cashier's Check, personal or company check or other posted method and must be received by the Auctioneer by the posted deadline.

Descriptions of items are provided as a guide. Gold marks on items are accepted as marked, but have not been assayed. Rolls of coins have not been verified. Stones were not removed from their mountings for testing or weighing. Neither Lone Star Auctioneers, Inc. nor the State of California assume any liability as to the accuracy of any description, quantity, weight, grade, quality, purity, value, or any other feature(s).

Lone Star Auctioneers, Inc. neither conducted an appraisal nor has any association with the appraiser for this auction. The appraisal is conducted under a contract with the State of California which is completely separate from the Auction contract. The Auctioneer has no control over the appraisal contract, and cannot warrant, stand behind or guarantee information contained in the appraisal. Further, Lone Star Auctioneers, Inc. will not refund or reimburse the buyer’s premium on any item based on errors and/or omissions of the appraisal.

Bid Rigging is a Felony

Agreements among buyers at auctions not to bid against each other for the purpose of purchasing goods at low and non-competitive prices is a criminal violation of the federal antitrust laws, punishable by heavy fines and imprisonment.

Section 1 of the Sherman Act (15 U.S.C. § 1) prohibits bid rigging agreements among competitors if they affect or restrain interstate commerce. Upon conviction, individuals are subject to a maximum fine of $250,000 and/or 3 years imprisonment. Corporations are subject to a maximum fine of at least $1 million. Anyone caught "rigging bids" will be subject to prosecution to the full extent of the law. Furthermore, anyone caught will be permanently banned from future bidding on any and all Lone Star Auctioneers auctions (live, webcast and on-line).
